‎ChezlesAbeilles.com is an e-commerce site accessible via the Internet at the address www.ChezlesAbeilles.com. It is open to any user of this network. It is published by Chez les Abeilles with a capital of 3000 euros, whose registered office is located at 396 route de l'Ecluse, 33660 St Antoine sur l'Isle, FRANCE.‎

 

‎The ChezlesAbeilles.com site offers for sale, cosmetics and well-being products to Internet users browsing the site. The Buyer prior to his order, declares to have full legal capacity, allowing him to commit himself under these general conditions of sale.‎

 

‎Any order of a product offered on the site ChezlesAbeilles.com implies the consultation and express acceptance of these general conditions of sale, without however this acceptance being conditioned by a handwritten signature on the part of the user.‎

 

‎In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001, adopted for the application of Article 1316-4 of the Civil Code and relating to the electronic signature, it is recalled that the validation of the order form as specified in Article 3.3. hereinafter, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.‎

 

‎It is specified that the user can save or print these general conditions of sale, provided however not to modify them.‎

 

‎Article 1: Purpose‎

‎The purpose of these general conditions of sale is, on the one hand, to inform any potential consumer about the terms and conditions under which the seller proceeds to the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the consumer. They apply, without restriction or reservations, to all sales, by Chez les Abeilles, of the products offered on its website ChezlesAbeilles.com.‎

 

‎Chez les Abeilles reserves the right to modify these general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.‎

 

Article 2: Products and prices‎

2.1 Products‎

‎In accordance with Article L. 111-1 of the Consumer Code, the user may, prior to his order, read, on the Site ChezlesAbeilles.com, the essential characteristics of the product or products he wishes to order.‎

‎In the event that a supplier modifies a product, the graphic representation of it can not engage the responsibility of the seller or even affect the validity of the sale.‎

 

‎2.2 Prices‎

‎The selling prices of the products online on the ChezlesAbeilles.com website, indicated in euros, are those in force at the time of registration of the order form by the buyer. ‎

‎They do not include shipping and order processing costs, invoiced in addition to the price of the products purchased according to the amount of the order. The shipping costs will be indicated before the registration of the order by the buyer. ‎

‎The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products on the site ChezlesAbeilles.com.‎

 

‎Orders to overseas departments, territories and local authorities as well as countries that are not part of the European Union, will be invoiced excluding tax. At the time of confirmation of the country of delivery, the invoiced amount will be announced excluding tax. On the other hand, the buyer will be liable for customs taxes upon receipt of his package.‎

 

‎The selling prices of the products may be modified by Chez les Abeilles at any time.‎

 

‎Article 3: Registration and validation of the order‎

‎3.1. Navigation within the Site

‎The user can read the different products offered for sale by Chez les Abeilles on its website. He can browse freely on the different pages of the site, without being committed to an order. ‎

‎The user shall bear the costs of telecommunications when accessing the Internet and using the site.‎

 

‎3.2. Order‎

‎Any order implies the adhesion without restriction or reservation to these general conditions of sale. ‎

‎From the moment the buyer has registered his order by clicking on the icon "Validate my order", he is considered to have accepted knowingly and without reservation these general conditions of sale, the prices, volumes and quantities of the products offered for sale and ordered. ‎

‎If the user wishes to place an order, he will choose the different products in which he has an interest, and will express said interest by clicking on the "Add to cart" box.‎

 

‎To order the products he has chosen, the buyer will click on "Order". The buyer must then identify himself, either by entering his e-mail address and password, if he is already a customer, or by accurately completing the form made available to him, on which he will include the information necessary for his identification with his surname, first name and postal address. ‎

‎The buyer is informed and accepts that the entry of any identifier is proof of his identity and expresses his consent. ‎

3.3 Final validation of the order‎

He will choose the means of payment he wishes to use to pay for his order, it being understood that the buyer must have the means of payment as defined in Article 4. hereafter. ‎Any fraudulent order or presumed as such, will be considered by Chez les Abeilles as null and void.‎

 

‎Article 4: Payment‎

‎All orders are payable in euros. The buyer guarantees chez les Abeilles that he has the necessary authorizations to use the payment method he has chosen, when registering the order form.‎

 

‎Chez les Abeilles reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the buyer, in the event of a payment incident or in the event of an existing dispute with the buyer.‎

 

‎To pay for his order, the buyer has the following payment methods: credit card, bank or postal check issued by a French bank, or bank transfer.‎

 

‎- The credit cards accepted on the site are the following: Carte Bleue, Visa, MasterCard, American Express, Discover and JBL. Payments will be made through the secure e-transaction system (online payment tool provided by Authorize.net). It uses the SSL (Secure Socket Layer) protocol in such a way that the information transmitted is encrypted by software and no third party can read it during transport over the network. In case of payment by credit card, the buyer's account will be debited on the day of his order.‎

 

‎- Bank or postal checks issued by a French bank:‎

‎Only cheques issued by a French bank are accepted.‎

 

‎- Bank transfers: In case of payment by bank transfer, the buyer will release his order from the order number concerned.‎

 

‎The cancellation of the order before sending the check or the transfer order is possible by simply sending an e-mail to commandes@ChezlesAbeilles.com specifying the order number. ‎

 

‎Chez les Abeilles will send the products upon receipt of the funds corresponding to the said order.‎

 

‎Article 5: Delivery and receipt‎

5.1. General rules‎

‎The products will be delivered to the address indicated by the buyer when ordering.‎

 

5.2 Characteristics of the Colissimo system of the POST Office‎

‎The buyer is delivered to his home by his postman. In case of absence, the buyer or the recipient of the ordered product receives a notice of passage from his postman, which allows him to collect the products ordered, at the nearest post office, for a period of fifteen days. ‎

‎The buyer is obliged to check, in the presence of the postal agent or the delivery person, the condition of the packaging of the goods and its contents on delivery. ‎

‎In the event that the buyer has any doubt of any kind whatsoever about the condition or content of his package, he is required: ‎

‎- to refuse the goods by immediately issuing a statement of anomaly to the postal agent. ‎

‎- to report these incidents within 48 hours to Chez les Abeilles in info@ChezlesAbeilles.com specifying the order number.‎

 

‎5.3 Deadlines‎

‎The delivery times, following validation of your order, are as follows:‎

‎- La Poste Colissimo: for France, 3 to 5 working days; for other countries delivered 5 to 10 working days. ‎

 

‎These deadlines are provided for information purposes only.‎

 

‎Any possible overrun may not give rise to damages, withholding or cancellation of the order by the buyer. ‎

‎In any case, and in accordance with the provisions of Article L. 121-20-3 of the Consumer Code, the products ordered will be delivered within a maximum period of thirty days from the day following that on which the buyer has registered his order, subject to full payment of the price. ‎

‎In the absence of delivery at the end of this period, the buyer will have the possibility to cancel his order. The sums paid by the buyer will then be returned to him without delay, to the exclusion of any other compensation.‎

‎In the event of a delay in delivery compared to the date initially set, the buyer must report it in writing (mail, email) to Chez les Abeilles in order to improve the quality of service that may be offered to him and to allow Chez les Abeilles to carry out an investigation with the carrier. ‎

A carrier survey can take up to 21 business days. If during this period the product is found, it will be immediately rerouted to the place of delivery‎.

‎On the other hand, if the ordered product is not found at the end of this period of 21 days of investigation, Chez les Abeilles will proceed at its expense to a new shipment of the products ordered by the buyer.‎

 

‎5.4. Unavailability of products‎

‎The products are offered within the limits of available stocks. In case of unavailability of one of the products, the buyer will be informed as soon as possible. This information may be notified, as far as possible, in the following way:‎

‎- when establishing his order ‎

‎- following the validation of his order, prior to delivery, by e-mail.‎

  

‎Chez les Abeilles will then make the necessary arrangements with its bank to subtract the price of the unavailable product(s) from the amount debited from the buyer's bank account, if the payment was made by credit card. ‎

‎In case of payment by check or bank transfer, Chez les Abeilles will refund by check the overpayment.‎

 

‎In all the aforementioned cases, the buyer will have the possibility to cancel his order by requesting either the refund of the sums paid within thirty (30) days at the latest after their withdrawal, by e-mail addressed to commande@ChezlesAbeilles.com, or the exchange of the unavailable product(s).‎

 

‎Article 6: Satisfied or Refund - Right of withdrawal‎

‎In accordance with Article L. 121-20 of the Consumer Code, the consumer has a period of 7 calendar days to return unused products and in their original packaging that does not suit him. This period runs from the day of delivery of the consumer's order. Any return must be reported in advance to Chez les Abeilles Customer Service by email or via our contact form. ‎

‎Only products returned as a whole, in their original packaging complete and intact, and in perfect condition for resale and not consumed, will be taken back. Any product that has been damaged, or whose original packaging has been damaged or consumed in part, will not be refunded or exchanged. ‎

‎This right of withdrawal is exercised without penalty. In the event of the exercise of the right of withdrawal, the consumer has the choice to request either the refund of the sums paid, or the exchange of the product. ‎

‎In case of exercise of the right of withdrawal, the refund by re-credit of his bank account (secure transaction) in case of payment by credit card, or, refund by check in other cases.‎

 

‎Article 7: Retention of title‎

‎Chez les Abeilles reserves ownership of the products sold until full payment of the price by the buyer.‎

 

Article 8: Liability‎

‎Chez les Abeilles cannot be held responsible for the non-performance of the contract in the event of out of stock or unavailability of the product due to a case of force majeure, disruption or total or partial strike including postal services and means of transport and / or communications.‎

 

‎Chez les Abeilles, in its capacity as an intermediary seller, cannot be held responsible for any direct or indirect damage that may occur as a result of the purchase of the products. Only the manufacturer's liability remains fully engaged, in particular under Articles 1641 et seq. of the Civil Code.‎

 

‎The Chez les Abeilles website contains information from third parties and links to other websites. Chez les Abeilles can in no way be held responsible for damages resulting from the use, access to, or inability to use this third-party information, nor the content of other websites.‎

 

‎Article 9: Partial invalidity‎

‎If one or more stipulations of these general conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.‎

 

‎Article 10: Non-waiver‎

‎The fact that one of the parties does not rely on a breach by the other party of any of the obligations referred to in these general conditions of sale cannot be interpreted for the future as a waiver of the obligation in question.‎

 

‎Article 11: Data Protection‎

‎11.1. Personal information‎

‎The provision of personal information collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders as well as for the establishment of invoices. This information is strictly confidential. The lack of information implies the automatic rejection of the order.‎

 

‎In accordance with the law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms, the processing of personal information collected on the Site has been declared to the Commission Nationale de l'Informatique et des Libertés. The User has the right to access, modify, rectify and delete data concerning him. Any dispute relating to the interpretation, execution or termination of the contract concluded between Chez les Abeilles and the buyer, even in the event of multiple defendants, will, in the absence of an amicable agreement, be the exclusive jurisdiction of the libourne court (33 FRANCE).
